Disclaimer

The New Zealand Symphony Orchestra (NZSO) may vary these Terms and Conditions at any time. By continuing to use the site after the terms have been varied you agree to be bound by the variation.

General terms

  • Tickets are sold by the New Zealand Symphony Orchestra and various Ticketing Agents. By purchasing a ticket, you will be taken as having read, understood and accepted the following Terms and Conditions
  • Booking, Transaction and credit card fees may be applicable
  • Tickets are valid only when purchased from the NZSO or an authorised agent
  • Tickets are non-refundable unless otherwise required by law
  • When purchasing a ticket it is taken as understood that it may not be possible to have a clear view of all artists on stage including NZSO players, conductor, and guest artists
  • The NZSO reserves the right to add, withdraw, reschedule or substitute any artist or performer
  • All dates, times, artists, repertoire, seating arrangements, venues and price reserves are subject to change or cancellation by the NZSO without notice. Where changes such as these are made, tickets are non-refundable unless required by law. The only exception is when an event is cancelled and there is no further performance of that event
  • Members to the NZSO can exchange tickets for another concert in the same season.  Ticket exchanges can not be transferred to following years
  • If NZSO Members are unable to use ticket(s) purchased directly from the NZSO Box Office, the value of the ticket(s) can be credited to their NZSO Membership account. To receive a credit, Members must complete an online return request form or contact the NZSO Ticketing Team before the concert date on the ticket(s). Credit can be used for NZSO concerts or Memberships and expires 12 months after the date of issue
  • The NZSO reserves the right to record, broadcast and simulcast any performance. If you are photographed, filmed or taped whilst attending an NZSO performance, you consent to the NZSO or third parties appointed by the NZSO, filming and taping you. The NZSO or third parties appointed by the NZSO can broadcast, publish, licence and use any photographs, film, recordings and images of you without compensation. The NZSO, the third parties and anyone acquiring from them a right to use the material are not liable to you in any way for its use
  • The right of admission is reserved and is subject to the NZSO’s and venue’s terms of admission
  • Late arrival to the venue may result in a seating delay until a suitable break in the event occurs, if any
  • Where special pricing is available, suitable identification will be required at the time of ticket pickup to prove that the conditions required for that special pricing are met
  • Child price tickets are available to those aged 18 years and under at time of booking
  • Flash photography, video or audio recording of any type is prohibited
  • Mobile telephones, pagers and personal devices must be set to silent before entry into the venue’s auditorium
  • The NZSO reserves the right to refuse admission where tickets are lost or damaged, or tickets are not purchased through an authorised point of sale
  • A charge may apply for the replacement of allocated (seated) tickets. General Admission (tickets where seating is not allocated) cannot be replaced
  • You acknowledge that you are responsible for your own property
  • You acknowledge that you are responsible for your own safety and for the safety of any person accompanying you
  • The NZSO is not liable to you for any claims, damages, compensation, losses or expenses as a result of an NZSO performance being cancelled, postponed or changed
  • To the extent permitted by the law, you release the NZSO (including its directors, officers, employees, consultants, contractors, agents and volunteers) from any liability for any damage, loss, liability or injury you may suffer in relation to your attendance at a venue, howsoever caused, including due to any negligence or other act or omission of the NZSO
  • You agree to compensate the NZSO for any damage, loss, liability or injury the NZSO may suffer as a result of your wilful, reckless or negligent acts or omissions at a venue
  • Your personal information is held by the NZSO, its ticketing agents and/or the Venue. It will not be sold or passed on to any other party. If you’ve opted to receive email updates from the NZSO and have provided an email address, you will be sent regular email newsletters. You can opt out of these at any time

Use and copyright

  • This Site and the information contained within it are for your own personal and non-commercial use only
  • You agree that you will not use any device or software that interferes with the proper working of this Site. You agree that you will not take any action that imposes an unreasonably large burden on the Site
  • The information contained within this Site (including programming scripts, graphics and logos) are copyright of the NZSO. You may make any copies of any information reasonable to your viewing of the Site and may retain a single permanent copy for your personal reference. The information may not otherwise be used, copied, reproduced, published, altered or transmitted in any form or by any means in whole or in part without the prior written approval of the NZSO.

NZSO Recording Aotearoa

Eligibility and selection criteria 

  • NZSO Recording Aotearoa is open to all composers and recording artists with arranger teams that hold permanent NZ Residency or Citizenship. 
  • The composer must not have been awarded this specific support (either NZSO NZ Composer Scheme or NZSO Recording Aotearoa) in the past seven years and must be able to adhere to all programme Terms and Conditions.
  • Selection criteria is purposefully open and flexible, however all projects will be assessed on both artistic premise and audience reach. Projects that align with NZSO’s vision mission and values and have evidence of impact on Aotearoa New Zealand’s creative scene will be viewed as strong candidates. It is also key to know in fine detail how you will approach financing the project if successful.
  • Application does not guarantee support of the project. If you are curious about what may work well under this programme please do reach out to the NZSO team for a ‘no-obligations’ chat to discuss your ambition and idea(s).  

Application process 

  • Expression of Interest (EOI) to NZSO via submission forms available will trigger an internal NZSO review of the project application. We aim to review and respond within 4 weeks of receiving EOIs. 
  • If approved, the NZSO will provide a quote for our costs and begin planning with the composer/creative team to create a work plan, timeline, and contracting process.  
  • It is important to note that if the payment of the NZSO fee and/or Michael Fowler Centre Venue Hire Agreement is dependent on grant awards or other funding, that evidence of successful application or letter from the sponsoring organisation must be provided prior to contract signing to confirm that the funds are guaranteed. If funds are being met by personal means or private patronage a signed and dated letter from individuals liable will be required. If decisions from multiple strands of funding mean that it will be impossible to provide these evidence options, an official guarantor for the fees due must be sought and a formal declaration provided. This financial evidence collation and submission must tie into the contract signing, i.e. a minimum of 12 weeks prior if project planned for Michael Fowler Centre.

Within the Expression of Interest, the composer/creative team must show evidence of:

  • Premise, ambition and potential reach of the project. Artistic personnel confirmed or in discussion; including conductor, soloists, arrangers, producer(s), and engineer team for sessions and post-production.
  • Written support from commissioning party if work(s) were commissioned (not required if NZSO was commissioning party).
  • Studio/venue pencilling options if the project is working to a fixed timeline; noting that if Michael Fowler Centre is the desired venue it is recommended that the NZSO team undertakes the availability exercise on behalf of the composer to ensure alignment with the NZSO schedule.
  • Ability to cover all associated costs of the project, or funding plan, including timelines and support required to achieve fund targets, noting, in particular, the guarantee cover of incumbent contracts for artistic personnel, venue, and the NZSO.
  • Timeline for recording and release, and a distribution plan.

If approved for inclusion in the NZSO Recording Aotearoa programme, the NZSO quote will include:

  • Project outline, including forces and guide session plan.
  • Full commercial hire rate of the orchestra calculated accurately to the project outline.
  • Operational and administration expenditure the project will incur (freight including orchestra truck, specialist instrument hire, extra players, library services, stage and orchestra management, contracting services, etc).
  • The NZSO Recording Aotearoa discount, making all staff player costs incurred 'in kind.'
  • Indicative venue and recording team costs on request only (noting that as per the T&Cs of the project NZSO will not subcontract any artistic or engineering fees for the project, and will only subcontract the Michael Fowler on request due to known prohibitive requirements regarding public liability insurance).
  • The NZSO’s establishment is: 3333 / 4331 / timpani, 3 percussion, harp / strings up to 16 14 12 10 8.
  • The above includes doubling on piccolo/alto flute/bass flute/cor anglais/Eb clarinet/bass clarinet/contrabassoon. 
  • Any orchestral instrument required beyond this establishment will be a professional, casual contract player booked by the NZSO (preapproved or specially approved by relevant section principal), and their fee will be charged directly to the composer. 

Prior to contract, the composer / creative team must agree to:

  • Administrative deadlines for the project.
  • Payment schedule (standardly 20% of fee due to the orchestra on contract execution, 80% due on completion of planned sessions + any agreed project on charges such as the venue hire contract). 
  • NZSO right of refusal on recording venue, engineer team, producer, and conductor (approval of which will not be unreasonably withheld).
  • Advance discussion and NZSO endorsement prior to confirmation of all other artistic personnel and production process.
  • Written notification of any adjustments to artistic and creative/engineering personnel included on NZSO recorded tracks throughout the process.
  • Scores and parts delivered to the NZSO library four months prior to the first session date, later date if required by advance discussion, and notice of format (i.e. pre-prepared hardcopy set or new PDF files requiring proofing and printing).
  • All stems from NZSO sessions being locked for the single purpose of the agreed release, i.e. no material from the sessions can be used in any live formats or transferred to secondary projects/releases unless otherwise mutually agreed in advance and confirmed in writing.
  • Released tracks featuring NZSO not including any other standard orchestral instruments (i.e. instruments or lines that may mistakenly be perceived as NZSO) or highly produced effects on NZSO stems within the mix unless agreed in writing prior to the session.
  • NZSO management sign off for any visual (still or AV) material made public.
  • NZSO brand adherence in all marketing materials, track titling and media/promo copy.
  • NZSO management final sign-off on relevant tracks prior to mastering (noting this to ensure adherence to agreed terms, not to engage in detailed creative feedback).
  • Advocacy of the NZSO Recording Aotearoa initiative both within the sector and publicly where required, and acknowledgment of the programme in all release copy and publicity.  
  • Recording inclusion to the list of recipients (ministerial reporting and archive via NZSO website).
  • It is also important to note that once the project is underway, the NZSO will only be able to dedicate the agreed time for recording. Great care must be given to accurately constructing content capture plans for the orchestral sessions to ensure all cues are recorded with best possible playing quality.

Promotion and distribution

  • The project and the recording's use, promotion and distribution remain in the hands of the composer and creative team throughout however, NZSO will lend support through press and social media requests as much as possible in the lead up and during the recording’s release. It is recommended that you meet with the NZSO marketing team in advance of fixing your campaign plans to make sure key points can be supported in our own SM and campaign schedules.  

Royalties and future earnings 

  • Standardly, the NZSO's commercially recorded material is contracted as 'buy out', and no further royalties / APRA AMCOS splits or similar are negotiated. 
  • It is the composer's responsibility to negotiate terms with all associated creative personnel. The NZSO presumes in good faith that all creative parties will be adequately remunerated for their involvement in the project. 

Social Media - Community guidelines
